Mobile Application

By accessing or using this Mobile application in any way, including using any Services, downloading Materials or registering on the Mobile application, you agree to and are bound by the terms and conditions set forth in this document and any changes thereto that Aashirwad EduVerse may publish from time to time (collectively, the "Terms of Use"). If you do not agree to all of the terms and conditions contained in the Terms of Use, do not access or use this Mobile application.

Your access and use of the Mobile application, Materials and Services will be subject to the most current version of the Terms of Use posted on the Mobile application at the time of such use. Please regularly check the "Terms of Use" link on the home page to view the then-current terms.

If you breach any of the Terms of Use, your authorisation to access or use this Mobile application, Services and Materials automatically terminates, and any Materials downloaded or printed from the Mobile application in violation of the Terms of Use must be immediately destroyed.

All required registration information provided must be current, complete and accurate and kept up to date on a prompt, timely basis. It is your sole responsibility to keep your user name/password combination and other sensitive information confidential.

If you become aware of any unauthorised use of your account or any other breach of security, please notify Aashirwad EduVerse immediately. If any Services or Materials provide password-restricted access to your personal information (including, but not limited to, usage records for Materials, and performance in tests and exams) then by accessing or using this mobile application and setting up a password-restricted account for such Services or Materials, you consent to Aashirwad EduVerse's display of such information via such Services or Materials and accept all risks of unauthorised access to such information.

The Materials and Services, as well as their selection and arrangement, are protected to the fullest extent possible by applicable laws related to copyrights, trademarks, trade secrets and all other intellectual property and proprietary rights (collectively, "Intellectual Property Rights"), and any unauthorised use of the Materials or Services may violate such laws and the Terms of Use.

These copyrights may belong to Aashirwad EduVerse or to its partners who have granted Aashirwad EduVerse the right to use their content. You agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the mobile application, Materials or Services.

Aashirwad EduVerse grants you a non-exclusive, non-transferable, limited permission to access and display the content within this mobile application, solely on your mobile phone and for your personal, non-commercial use. This permission is conditioned on your not modifying the content displayed on this mobile application and your keeping intact all copyright, trademark, and other proprietary notices.

Aashirwad EduVerse will, in appropriate circumstances, terminate the accounts of users who infringe the Intellectual Property Rights of others. Aashirwad EduVerse will investigate notices of copyright infringement and take appropriate actions.

If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on this mobile application or in connection with the Services or Materials, please provide notification of claimed copyright infringement to our registered email address.

Aashirwad EduVerse may block, restrict, disable, suspend or terminate your access to all or part of the free Mobile application, Services and Materials at any time in Aashirwad EduVerse's sole discretion, without prior notice to you or liability to Aashirwad EduVerse.

Specifically, after a period of inactivity, Aashirwad EduVerse reserves the right to disable or terminate a user's account. If an account has been deactivated for inactivity, the user name associated with that account may be given to another user without notice to you or such other party. If you violate the terms and conditions, Aashirwad EduVerse may, at their sole discretion, block, restrict, disable, suspend or terminate the paid conditions.

In the event of your or others' access to or use of the Mobile application, Services or Materials in connection with the transmission of spam newsgroup postings or unsolicited e-mail in violation of these Terms of Use, you acknowledge and agree that Aashirwad EduVerse would be irreparably harmed thereunder and that monetary damages would be an insufficient and ineffective remedy.

Therefore you agree that Aashirwad EduVerse is entitled to obtain immediate injunctive relief against any such transmission (in addition to all other remedies available at law or in equity). Aashirwad EduVerse may without restriction block, filter or delete unsolicited e-mail.

Aashirwad EduVerse may run advertisements and promotions from third parties via the Services or Materials in any manner or mode and to any extent. Your communications, activities, relationships and business dealings with any third parties advertising or promoting via the Mobile application, Services or Materials, including payment and delivery of related goods or services, shall be solely matters between you and such third parties.

You acknowledge and agree that Aashirwad EduVerse is not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such non-Aashirwad EduVerse advertisers on the Mobile application or in connection with the Services or Materials.

Aashirwad EduVerse's registered office is located in India. By accessing this Mobile application, you agree that all matters relating to your access to, or use of, this Mobile application shall be governed by the applicable laws of the jurisdiction in which Aashirwad EduVerse is registered.

You agree to indemnify and hold Aashirwad EduVerse and its officers, partners and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of:

• Your User Materials and any other content that you may submit, post to or transmit through the Mobile application.
• Your access to or use of the Mobile application, Services or Materials (including any use by your employees, contractors or agents).
• Your connection to the Mobile application, Services or Materials.
• Your violation of the Terms of Use.
• Your infringement of any third party's Intellectual Property Rights when using any of the Software made available on the Mobile application.
• Your violation of any rights of any third party.
• Your access to or use of Linked Mobile applications and your connections thereto.
• Any dealings between you and any third parties advertising or promoting via the Mobile application, Services or Materials.

Our content is created by experts and goes through strict quality checks. The Mobile Application is available to users on an "as is" basis, without any warranties as to accuracy, fitness for use for a particular purpose, merchantability, freedom from any errors, defects or non-infringement. Aashirwad EduVerse does not make any warranties that the mobile application shall always be running and free of downtime, or that it shall be error-free.

Our mobile application may be temporarily unavailable at any point of time due to maintenance, up-gradation or any other reason.

We reserve the right to modify without prior notice and in our sole discretion to refuse Service to any person. We reserve the right to accept or reject registrations on Aashirwad EduVerse mobile application. We reserve the right to change prices for all our Services, offers or deals.

Cancellations

• As a general rule, all sales made on Aashirwad EduVerse are final and you shall not be entitled to cancel your order once you have received confirmation of the same.
• We reserve the sole right to cancel your order in case we are unable to deliver the order in a satisfactory manner, or if the user tries to take advantage of the system outside the standard terms of use.

Refunds

• You shall be entitled to a refund only if Aashirwad EduVerse is unable to deliver the mentioned services.
• All refunds will be processed on a pro-rated basis, depending on the service already delivered by Aashirwad EduVerse.
• Refunds will be done directly to the original payment mode within 7 days of finalization of claim.

Aashirwad EduVerse is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this mobile application or APP, then you can be assured that it will only be used in accordance with this privacy statement. Aashirwad EduVerse may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

We may provide personally-identifiable information to service providers who help us bring you the Service, such as hosting the Service at a co-location facility or sending emails. Where we utilize service providers for the processing of any personally-identifiable information, we implement reasonable contractual protections limiting the use of that personally-identifiable information to the provision of services to Aashirwad EduVerse.

We may be required to disclose personally-identifiable information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. Additionally, we may share account or other personally-identifiable information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Service or using Aashirwad EduVerse's name, or to prevent imminent harm.
